Question posted in the Consumer Protection Law category relating to Gauteng
Hi I want to cancel my Rain network services but they are telling me I have to pay first before cancelling. When I joined Rain I was happy that it was on a month to month basis, I would pay on the 1st of the month if I want internet access and when I don't pay on the 1st then I don't have internet access for that particular month. October 1st 2022 I didn't pay and my internet was immediately disconnected and because I currently don't need the services I decided I would cancel but then they sent me an email saying I should pay for the month first before cancelling, why should I pay for services I never received, services that were immediately cut off by Rain?

Hi there,
I see that you haven't made a payment for the question, but I'm going to assist you a little. If you want to ask a follow-up question, please make the required payment, even if it is R150 or R200.
Most service providers, who provide services on a month-to-month basis, have a one calendar months' notice period cancellation policy. This means that you need to give 1 full calendar months' notice if you want to cancel.
So, if you give notice on 3 December, the cancellation period actually is the month of January (because that is a full month) and your services would then terminate on 31 January.
However, if you give notice on 30 November, the cancellation period would be the month of December (because that is a full month) and your services would then terminate on 31 December.
So what they are saying is actually legally and contractually correct.
You should have paid before 1 October for October's internet. But you didn't. So now you need to give your calendar months notice, and then catch up the arrear months where you didn't pay.
