Question posted in the Consumer Protection Law category relating to Western Cape
Hello.
i bought a car from a dealership in january 2024 and paid for it in cash. it is now may and the dealership still has not given me my car nor have they given me a refund. instead, i have seen the very same car i bought being avdertised by the dealership in a different province.
i want to approach a court but need to ensure that its urgent and i will be either given my car urgenly or an immediate refund as i have seen a car that i can buy (if i get a refund) and it may be sold soon. i dont have other means of transport because i sold my car to buy this was that is now being witheld from me.
initially i thought about a spoliation order but not sure if its ocrrect sice i never was in "peaceful and undisturbed possession" of the car. please help. what steps can i take that will expedite the process
