Question posted in the Property Law category relating to Free State
My ex wife is refusing to leave a property I previously owned (in the divorce settlement she had 1 year to vacate whilst I paid the bond on the property) I can no longer afford the bond, and she has not (and refuses to) vacate the property. I have not paid the bond for 11 months (since the date that she was supposed to leave) I just received a summons from the bank regarding the non-payment of the home loan - will the property be reposed and auctioned/sold by the bank and will I still owe any money thereafter to the bank for this home loan? I do not have any rental agreement with my ex wife and she has not paid anything towards the bond. ( as mentioned she was supposed to leave 11 months ago according to the divorce settlement but then claimed she lost her job)
