Question posted in the Property Law category relating to KwaZulu-Natal
We as.landlords working through an estate agent signed the lease agreement and addendum, the tenant had signed first, then the agent sent the lease back for us to initial further changes which I did not do. We then informed the agent that we are no longer going to proceed with renting the property. No deposit or rent has been received by the landlords, I think the tenant had paid the deposit and first months rent to the agent.
We as landlords had a change of strategy with the property and want to either occupy or sell the property. The agent is now sending threatening messages, which i have not responded to, they want to know the reason why we are cancelling the lease and mention the tenants rights in twrms of the CPA. Have we done something wrong, what are the consequences and best way forward as we are not prepared to give the agent access to the flat.
