Question posted in the Property Law category relating to Gauteng

A person who is the legal owner of a vehicle asked me to fetch his vehicle from a repair shop who was threatening to charge R250/day in storage costs if left there for longer than 3 days. This was in May 2023

He asked if I would look after the vehicle and store it next to my vehicle in our complex for a maximum of 2 weeks.

He promised to pay me for all costs relating to this collection before collecting the vehicle. He has made 2 arrangements to collect the vehicle and has honoured neither. He has also not attempted to reimburse me for my costs.

I have explained on various occasions that the storage of the vehicle has had a very negative impact on me financially, as I have been presented with parking bills for the vehicle, and even worse than that, my arrangement for a free spot has been compromised and I found myself being billed for both my vehicles and my trailer.

My costs thus far are in the region of R40,000 so far. I am now being fined by the landlord/body corporate every month, and I am now being threatened with eviction if I don't resolve this by the end of October.

I have decided to get the car moved to a repair shop nearby and leave it there. They have agreed to keep it for 7 days at no cost, but if not collected, they will charge R175/day for storage.

I don't have a legal residential address for the owner (Natal/Drakensberg area) The car is registered in Lesotho in by him, this is the only address attached to the vehicle.

I need to get the owner to pay up, or I need to sell his vehicle to recoup my expenses.

What are my options?
