Question posted in the Landlord Tenant Law category relating to Gauteng
My lease expired in 2021 as a fixed term. I have lived there for 4.5 years. I gave my notice in on the 1 November and vacated on the 30th. My landlord made an arrangement verbally with my brother in law as they had trouble moving on the weekend. My landlord stated that I will now be on a month to month even though since 2021 I have been on a month to month. I have paid all my rental. He has now sent me a letter of demand for a month's rent even though I do not live there as of the 30th november. He has a history of intimidation, discrimination with emotional abuse. I do not have an agreement with him. He has also started work on the unit and says we need to have an out going inspection even though the moment my notice was given 3 day later he came in to do an inspection. Do I still need to do an inspection. My questions are, do I have to pay the demand even though I no longer live there or a tenant and the agreement is for my brother in law and do I need to have another out going inspection? Also, what are my legal grounds as he is the type of landlord that believe tenants don't have knowledge of the law. He has also left maintenance outstanding for a year whilst living there. He has tried to take me to the tribunal but they rejected his claim. Is what he is doing legal?
