Question posted in the Landlord Tenant Law category relating to Western Cape
Greetings, I and my roommate (I met them online) recently found a place and had a move in date last week. The place was found by the parents 2/3 days prior to the move in date and as such, things moved quite fast. The roommate's parents opted to take the lease in their name and I was honest about my ability to pay the deposit (I can only pay them back for covering my portion over time). They paid the deposit and we have not yet entered into a subleasing agreement as we did not have the time to iron out a few kinks. They sent me a subletting agreement and I reverted back with one of my own. Though it was initially well received, one of the parents called back later expressing how he was unhappy with the terms that were laid out and told me to "bring him back something better". The conversation was quite condescending and I do not believe I wish to play out the remainder of this agreement as it has gotten off to a rocky start. As a show of good faith I did send the first rent (R8kk) plus a portion of the deposit (R4k) but expressed that as discussed before, I would prefer to pay off the deposit over a slightly longer term (6 months as opposed to 4).
I would just like to enquire what legal obligations and holds they have against me/I have against them. I have yet to sign the subletting agreement as everything was rushed and we had not come to a conclusion. Is there any recourse should I wish to terminate the lease entirely (I am listed as an occupant in the initial lease). ?
