Question posted in the Criminal Law category relating to Western Cape
Court didn't call 7yrs old child rape complainant to testify in court,because the child is too traumatised,what rights does an accused has in this regard?The child gave her statement in chief bt couldn't disclose to a social worker about the alleged incident and the trial went on without her testifying.only witnesses who saw the accused walking with the child testified and the doctor who examined the child and confirmed allegations
