Good day. I trust that you are well? I just want to say thank you in advance for taking the time to advise me on my following situation:
I have a verbal agreement that took place on the 7th February 2021 with JP, living in Bloemfontein, Free State, that he is going to buy a vehicle by me. The agreement was that he will pay the whole amount of R75000 at the end of February 2021 when his stepfather's state pension pays out. Today is the 13th February 2021 and I have still not received any payment from him and the vehicle is in his possession.
I told him that I want to fetch the vehicle, and keep it by me and as soon as he had the money we can continue with the transaction. He then told me that he has recordings of me agreeing that he can pay the money as soon as his stepfather's pension pays out, buy in the same recording that he claims he has he also said that it would be the end of February and that if I fetch the vehicle, I have to bring him another vehicle he can use for is towing business and pay him the money back he used to fix the vehicle, R5500.
He has been in contact with me ever since, but every week I follow up with him he tells me that the money is going to pay out the next week. He said to me over WhatsApp that the payment will definitely be made on this Monday coming.
What 'foot' does JP have to stand on and what legal steps can I follow regarding this situation.
I am living in Kimberley that is about 250km from Bloemfontein.
