Good day
I wish to have some sound legal advice as to what my position is
I worked for a BEE company and one of the colleagues a young black man constantly made sexual comments towards me, made sure that he always wanted to "high five" and touch me, had the habit of putting his hand on my shoulder when he walked next to me, asking me to invite him to my house to have coffee and to party with my friends over weekends and I told him categoriclly that I dont do that and dont socialise with any colleagues after hours, and asked him to drop this matter once and for all
BUT then we had to do a busines trip together. This is what transpired on the trip:
On fisrt night at the dinner table he made a comment to the black waiter t the hotel that we will take the bottle of wine to "our room" he must just bring us two clean glssses. I told the waiter that will not be the case. got up and went to my room. This man then insisted walking me to my room whcih he did as he does not take no for an answer, and when I got to my room he sort of lingered around and I just shut the door
The next day on our way back to JHB he started playing very suggestive songs with sexual content which was extremely embarrassing. Then he started talking about his private parts when aroused and what a sexy white woman does to him and that he does not get sex from his wife etc etc and that he likes white women
I then told him to pse change the music or switch the radio off in has car as we still had 300lklms back to JHB and I felt vey uncomfortable and unsafe in fact as it was getting dark.. I refrained from talking to him for any reason whatsoever and the trip went off in silence after that last indicent.
He has made comments often that he wants to visit me at home and I told him no one needs to know where I live his comment was "oh so you dont wish for me to know where you live"
I came back to the office the next day and told the one white directors from the Secunda office, he promised to do something about it., I also told the CA of the company (an indian man) neither did anything to get this matter addressed or sorted and just once again swept it under the carpet once again.
This black man then started making my life unbearable at work as he knew it being a BEE company I stood no chance if I spoke up to the CEO (a very prominent black business man as well) until I left the company on 5th August due to the uncomfortable position. Now I am without work or any sort of income thanks to this matter who no one at the company wanted to address
I wish to bring a sexul harrassment case against this black man and wish to know what my chances are of being successful.
