Greetings
I've recently made an offer to purchase a property. Part of my offer was that I would take occupancy on the 1st of December 2015 and should transfer only occur after this date, then I would pay occupational rent for the days from occupancy till transfer.
On the 18th of September 2015 my bond registration attorney's requested the necessary documents from the sellers chosen tranfer attorneys. To date, these documents have not been provided and the reason given by the transferring attorneys is that they have moved offices and have not yet drawn up the necessary documents.
I'm concerned that this delay which is solely due to the sellers transfer attorneys lack of services, is going to cause me to pay additional occupational rent which would not have been the case had they done their jobs professionally and on time.
Is it within my rights to not pay occupational rent for the time period in which the seller's attorneys were unable to perform the services that they are being paid for?
