Good day
I would like advice on whether this would be handled under family or corporate law.
In 2001 as a family we all took out loans to purchase a undertaking business which was registered under my father's name as a cc. Now it appears as though the funds have been mismanaged to a point where the company has been deregistrered. The concern is that my he and my mother are married in community of property and all he is having an affair. Can he be held liability for the state of the business without it affecting my mother. As well as in the event of a divorce, would there be grounds for him to take half of everything even though he had probably spent the business' money, which was purchased by the family, on his mistress.
