Question posted in the Divorce Law category relating to Eastern Cape
Hi, I need some advice please.
My brother & his wife were married for 30 years, Antenuptual without accruels, before 1983. When they got married she owned a property (Flat). Her mother sold her property and put the money into my brothers property. Over the years he paid for the houses (bonds) as he was emplyed in the Navy and received a subsidy.
Things went bad roughly 5 years ago when he left the Navy after 25 years service. He got sick (depression) and was unemployed and has been ever since. He picked up a gambling problem on top of this.
This been said, while he was sick, in and out of a psychiatric hospital, she threw him out the house as there was alot of arguing and fighting. She had to get a protection order at one time as he threatened her. (note the man wasn't well at the time). She then convinced him to sign the property over to her for safe keeping and if he did so they could "reconcile". He did this. She got a friend who was an Estate Agent to draw up documents and he signed the house over to her. In his mind this was for safe keeping as he was unemployed and he felt it the correct thing to do.
She has in past few years thrown him out of the house a few times. He has always ended up staying with me.
I have had to feed him and look after him at my expense.(Note his house is in CT and I am in PE). He was last thrown out the house around 6 months ago and has been with me ever since, living in a small back room. I have purchase an old carpet cleaning machine so he can at least make a little money on occassion.
It has now come to our attention that she put the house on the market, without telling him, and its sold.
We sent her two lawyers letters recently requesting a settlement and a divorce.
She has ignored both letters.
What can we do to ensure he gets whats rightfully his share ? Is he entitled to a share ?
