good day,
i am asking for a friend.
3 years ago her brother went to jail for murdering his wife. they were divorced for 3 months prior to the murder. before they got married he had a house, and the house is still in only his name. they were married in community of property. Before her death she purchased a car, while still married. When she died her eldest brother took the car and has been driving it for the last 3 years. he sold it a few weeks ago. my question is can he do that? even whilst the husband is still alive but in jail? they also have two children, aged 16 and 8 which is in the care of her younger brother. my worry is that they might want to sell the house aswell. will they be able to do that? Does the ex husband who is in jail have no say whatsoever?
