Question posted in the Criminal Law category relating to Gauteng
I was arrested and charged by my ex husband with intimidation and malicious damage . I was also removed from the house where I lived with him by the police as that was one of the conditions of the bail. I paid an attorney to bail me out . When I went to court the judge threw it out. At the same time my ex then served me with a protection order at the court . Thereby ensuring I dont return to the marital home . He was extremely abusive and cruel . The last month he has been trying to sexually force himself on me . I had to fight him off and warned him I will report him to the police . What recourse do I have for the wrongful arrest ? I am also opening a case of sexual assault as I'm traumatized by all this . The cops didn't say I was getting arrested when they came to the house. They merely said we need you to give a statement at the station . I was so disturbed by all this that I cannot function at all.
