Good Day,

I urgently need advise.

We stayed at a place for 26months. Out the 26 months we only had a signed contract for 12 months. After that we never received a new contract from the landlord. We basicly stayed on a month-to-month basis. On the 03.11.2019 we gave the landlord notice. We moved out on the 30.11.2019. The landlord said that she cannot refund our deposit because, we did not gave her 2months notice. As far a my knowledge go, if you stay on month-to-month basis only 30days notice is sufficient. The landlord also said that if she can get someone to move in asap she will try to refund our deposit. This sound to me that my deposit was never placed in a interest account.

We said that new tenants can come view the property from 17:15 to 18:00. The Landlord did not bring anyone to view and she is saying that our viewing times did not fit in for the viewers. Not once did she ask us if we can arrange for a viewing during the days. Husband and myself is working 8hours daily.

What is my rights as a tenant to get my deposit back
