I have been dealing with ABSA vehicle and asset finance paying off a car loan.
End of Last year while talking to an ABSA consultant over the phone on a recorded conversation about the final due date of my vehicles residual payment I was told the due date was the end of November 2019 by the ABSA consultant.
At the end of Nov 2019 i was contacted by ABSA telling me that actually my payment due date was months earlier (31 of August 2019).
I then immediatley applied for re-financing on the residual payment but was rejected because months had passed since my re-finance application was requested and the payment due date had elapsed.
I tried to explain to ABSA that the reason for the period between payment due and re-finance request was because I recieved false and misleading information from their consultant about the actual date the residual was due.
No response from ABSA.
I then laid a complaint through their "complaints department" so that I could take the matter further with the SA finance Ombudsman.
I was told by ABSA an investigation would be conducted and that i would be informed of the outcome of the investigation.
I was never infomed of the investigation outcome of my complaint.
So in the meantime I applied for re-structuring on the residual car payment and was informed via email that the application had also been rejected: "We are unable to process your restructuring request due to you don't qualify.Account closed and residual was due on the 31/08/2019, please contact legal at 011 3304661/4116 for arrangements."
Last week (31 Jan 2020) I was contacted by an ABSA consultant "Risk Mitigation Officer" who wanted to know why I had not made my agreed upon payments under my re-structuring application!
I informed the ABSA "Risk Mitigation Officer" that I received an email from re-structuring department stating my application had been rejected.
He then informed me that actually my restructuring application was successful... Even though ABSA sent me an email stipultaing my rejection.
On multiple occasions now I have received false and misleading information from ABSA about very sensitive financial information that led to incorrect decisions made on my part with very serious consequences for myself such as ABSA continuing to unfairly trash my credit score and thousands in additional interest charges I am expected to pay amongst the emotional distress this has caused me.
I am hoping I have an avenue of recourse against what I believe is a conspiracy by ABSA to defraud me of my Vehicle though false and misleading information given to myself on multiple occasions by multiple ABSA consultants.
