Question posted in the Consumer Protection Law category relating to Gauteng
Good Day
I signed an Offer to Purchase a car and they reqiured holding deposit of R2000. With the little money i had i went and put R5000 as holding deposit. Unfortunately my financer declined to finance the car due to price difference of same car with lower mileage and the dealership did not lower their price. i informed the sale person that iwould not be taking the car and would like my holding deposit refunded.
He told me that the company said i would not be getting any money back as they declined to sell the car to another customer since i had put holding deposit and wasted their time and sale.
On the offer to purchase form has a part where it says if i am in breach of contract or if i am entitled to cancel, i agree that they may deduct a reasonable admin or cancellation fee if they are entitled to do so by law.
currently they all are not responding to my calls and the sales person has distanced himself from my calls.
please assist on way forward,i am in need of the money to pay for my son's Occupational Therapy fees.
