Question posted in the Divorce Law category relating to Gauteng
My husband and I got divorced 1.5 years ago. We were married in community of property. We reached a settlement and the divorce was uncontested. My question is regarding the property (house). According to the settlement 1) We are joint owners of the property 2) The bond stays in both our names 3) The respondent (my ex husband) is responsible for all the payments re property (bond repaiment, rates and taxes etc). We also had a verbal agreement that a 3rd party would not move into the house. If he meet somebody and they want to live together/get married, he will move out and our son (25) will stay in the house then.
Ok... he dis meet somebody and she did move into the house.
I want 50% of the value of the property paid to me.
1) Can I ask for him to do that?
2) If he don't want to, is there a legal route to get it done?
He would't have to sell the house...he does have some investment that woul cover the amount.
