Question posted in the Property Law category relating to KwaZulu-Natal
I have a vehicle that was collected by a debt counsellor from a lady who took over my installment. The debt collecting company said they will pick up the vehicle to put on rent to own then we do not have to pay them anything. When picking up the vehicle the engine light was on and they still drove the vehicle until the engine broke. They told me they will fix all damages on the car as it was in their possession. The vehicle is giving constant problems and they do not want me to take the vehicle as they are holding me liable for the car damages. I have not rceived any documents on what was discussed or invoices. Can i take my car and still be held liable for the payment of damages when they knew there was something wrong with the car and still drove it and not load it on a truck?
