Ek benodig advies omtrent die vruggebruik itv van my erflating bemaak (soos 4.6.2 en 4.6.4) vanuit my pa se testament:
4.6 Indien ek te sterwe kom terwyl my plaas eiendomme in die proses van verkoop is, bemaak ek my boedel as volg:
4.6.1 'n Kontantbedrag van R800 000 (Ag Honderd Duisend Rand)aan die XXX Trust hierbo vermeld.
4.6.2 Die restant van my boedel in gelyke dele aan die XXX Trust hierbo vermeld en my dogter XXX na vereffening van alle boedelkostes.
4.6.3 Bogenoemde bemakings is onderhewig aan die betaling van sodanige bedrae aan my moeder soos wat ek huidiglik verplig is om te betaal ten einde haar bestaande lewensstandaard te handhaaf deur die twee erfgename in gelyke dele.
4.6.4 Bogenoemde bemakings is onderhewig aan die vruggebruik van my eggenote XXX. Ek gelas die Meester om af te Sien van sekerheidstelling.
Paragraaf 4.6.2 is nie meer van toepassing aangesien my pa se Moeder reeds oorlede is.
Wat is presies behels XXX se vruggebruik regte op die deel aan my (XXX) bemaak soos per 4.6.2?
Is XXX slegs geregtig op die rente verdien of ook op beide rente & kapitaal?
