Ms A and Mr Z are childhood friends who entered into a contract of sale for a car. The selling price was R500 000. They agreed that Ms A would deliver the car to Mr Z on 5 January 2022. The contract was concluded in Pretoria where both Ms A and Mr Z reside. On 5 January 2022, Ms A failed to deliver the car as per the agreement. Mr Z contacted her but the phone went straight to voicemail. Mr Z then sent a letter of demand for Ms A to deliver the car as stipulated in the agreement, but to no avail. On 5 January 2023, Mr Z instructed his lawyer to institute a summons in the Ekurhuleni East District Magistrate Court against Ms A for the enforcement of the contract.
Does Ekurhuleni East District Magistrate Court has jurisdiction in relation to the matter described above?
