Good day,

I hope you can assist. My brother was involved in a very serious car accident early 2020. He was hospitalized for about 7 months. Once he was discharged and recovering at home, his wife enlisted the services of an attorney to assist him with the RAF claim process. He kept following up with the attorney with no success in the past couple of years, early July 2024 the attorney reaches out to him and tells him that his RAF claim will be paid out soon and extends a loan of R200k to him that he will pay back with 50% interest, he took the R200k. We as his family were not aware of this until this past week. We suspect the RAF paid out and that she is withholding this money and is giving him this loan to make more money from him and the wife is in on this as she is the one that communicates with the attorney on this matter on his behalf since hasn't been well. The attorney told him her fee to facilitate the claim on his behalf with the RAF is 30% of the payout when its supposed to be 25% and then she says the RAF will withhold another 30% before they pay out because they do not understand his story of how the accident happened, which for me is strange because why is the RAF even paying out in the first place if they do not understand how the accident happened? He reached out to the RAF yesterday to enquire if the money was paid out and he was requested to share a copy of the contract he signed with the attorney, they can only provide more details once they have the copy of the signed contract, he doesn't recall signing a contract perhaps the wife signed on his behalf, we do not know. He reached out to the attorney for the copy of the signed contract yesterday and she panicked, she and the wife shouted at him because he enquired at the RAF about the status of his matter, she is refusing to share the copy of the contract with him. What can he do in this case?

Your assistance is greatly appreciated.

Warm regards,

Tebogo
