Good day, We are trying to cancel our lease as per the consumer protection act with the 20 business days notice. Our lease agreement stiupulates 20% of the remaining rental for the year as a penalty - more than happy to apy that. She just does not seem to want to accept this. We also don't have an address on file for her anywhere to send our notice to on a physical letter, can we send it via email and text? Will it stand?And can she sue us? WE've always paid rent on time, the only thing we want is early termination of a fixed lease, we can't wait 3 months. We have a new place in mind and I want to pay the deposit to secure it. We have had maintenance issues, the one wall is full of damp and this hasn't been fixed or tended to since we moved in. A month ago she said the builder "will come in this week" nothing happened. In the event she tries to take us to court, can we use this? We have not damaged the property ourselves at all.
