My name is Candice Royce, and I am seeking legal assistance regarding a series of financial challenges I have faced, primarily involving ABSA Bank and a previous personal loan. In 2014, I lost my job and subsequently fell behind on my financial obligations, leading to a default judgment against me in 2018. This judgment remained on my credit profile for five years, severely impacting my ability to secure stable employment or housing. Despite these challenges, I endeavored to rebuild my life and, in 2019, established a small business. I opened a cheque account with ABSA, where I received an unexpected offer for a personal loan despite my ongoing credit issues. I was granted a loan of R66,000 at a high-interest rate, but I was not required to provide adequate proof of income, which is particularly concerning given my self-employed status and lack of a registered business. Unfortunately, my business was severely affected by the COVID-19 pandemic, leading to further financial strain. I was paying monthly installments, including an insurance policy that I believed would cover my payments in the event of loss of income. However, I was informed that this policy did not cover self-employed individuals, leaving me without support when I needed it most. After requesting payment relief during the pandemic, I struggled to keep up with my financial obligations and, ultimately, I could not continue making payments. Recently, I discovered that ABSA had obtained a default judgment against me in 2022, for which I did not receive a summons due to an incorrect address on their records. Given these circumstances, I am concerned about the reckless lending practices of ABSA and am considering whether I have grounds to challenge the recent judgment. I am also exploring options to negotiate my debt or have the judgment removed, as it continues to adversely affect my ability to rebuild my life.
