Hello, I bought a property that transferred on 1st October. On getting the keys and the house being fully vacated, it was evident that the back wall of the garage was damaged, and the garage roof (it rained that week) was leaking. I notified the attorneys immediately. I sent through two quotes on getting the roof and wall repaired. The damaged wall was only evident when opening the garage, which we had not done prior to the sale.
The sale was signed stating the electric fence would be in good working order, which it was not and the seller and lawyer had to get the contractors in. They also stalled this process. During this period, the property was broken into and building goods to the value of R17000 were stolen. CCTV footage was found and the burglar gained access via the not-working electric fence.
I have requested a meeting which they have been delaying and the meeting is now happening.
I would like to know if the seller is responsible for both losses - the latent defect on the garage roof and wall - and the loss of goods?
