Question posted in the Landlord Tenant Law category relating to Gauteng
Good morning,
Can anyone maybe assist me with a renting contract.
Unfortunately due to my work not paying me for 3 months we can no longer afford to rent, all my payments are up to date thanks to some family members.
I gave 1 month written notice over whatsapp and email to our lessor.
We signed a contract for one year but in the contract it states" This lease shall come into operation on July 2024 and shall
terminate on 31 December 2025 subject to the proviso that any party may terminate this agreement on 1 (one) months’ written
notice given to the other party. "
Now the lessor wants to charge us with a 3 month penalty? But it doesn't state anything regarding a penalty in the contract?
What can we do, because obviously we can't afford one months rent anymore what about 3 months rent?
What rights do I have, or is the lessor just bluffing ?
TIA
