Question posted in the General Law category relating to KwaZulu-Natal
My husband had an incident at work wher he injure his back. After 3 days the Neurosergeon said it is not an iod as it is a pre-existing condition and due to years of deteriation he is in need of a operation now. My husband had no pain or even had medical advice for back pain and he performed his duty at work as was required from him. Now after the incident he is in constant pain and can not perform his duties at work. It is now going for 3 weeks and his employer said due to the drs report he is not liable for a IOD claim. Is this fair and true. The financial impact on us for doing the operation on our own cost is extreme and can not aford it at all. If he does not do the operation he needs to give a letter to the employer to say he will not hold the employer liable for any further injury resulting of his back injury and his injury is not allowed to with held him form doing his job.
