Hi,

I have been given a letter of authority by the high court for my late aunts house. I would like to transfer the property on my own name. My late aunt left no will and had no husband or kids. Her siblings have given me permission to transfer the property onto my name.  The property has been not been transfered since my late aunts death in 2005 ,  and the tenant has not paid rent since my aunts death. How would i go about transferring the property to my name and getting the tenant to pay rent?

Because there is no Will, you need to wind up the estate in accordance with the laws of intestate succession, which means that your late Aunt's siblings are the owners of the house. So, you need to transfer it into their name. Then, you will need to purchase the house from them.

All of this must be done through a conveyancing attorney who can assist you in preparing the documents and actually lodging same at the Deeds Office.
