I have been contacted by a debt collection attorney regarding a judgement against me in 2001 in favour of BOE Bank. The debt was as a result of an error by BOE on a property sale pertaining to the settlement amount. After settlement of the bond, BOE came back to me a few months later saying they had made an error on the settlement and that I still owed them R16000. Unfortunately, I agreed to pay them in instalments but due to financial difficulties I failed to pay in full and judgement was taken against me.
In 2006, I was approached by collection attorneys again and I agreed to pay what I could. The payments were to be reviewed each year but they failed to do so. The last payment was made to them in 2009, and I have never had any communication from them since then until now. I am now a pensioner. What are my rights in this matter?
