Question posted in the Landlord Tenant Law category relating to Eastern Cape
After my rent had fell in arrears the bailiff took possession of my belongings. BUT I had moved off the premises it was kept at that time and wasn't there when it was being taken and I suspect that
1 it was only collected after the rent was paid up (however I did not provide proofs of payment at that stage so they were not aware of payments)
2 that the things were taken away by the landlord and his legal representatives and not an actual bailiff.
3 I owed about R4600 but all my stuff were taken to the value of R40 000 at least.
Nothing was sold and now I'm told that I need to go fetch my stuff and am liable to pay storage costs. The problem is I've moved to another city 1000km away and made arrangements with a removal company to move these things prior to my knowledge that it has ended up at the bailiff.
IS THERE ANY PROCESS I CAN FOLLOW SHORT OF HAVING TO ACTUALLY FETCH THE THINGS MYSELF? I don't mind paying any fees, but I am not there to go collect anything and do not wish to burden anybody else with this.
