Question posted in the Family Law category relating to Western Cape

Good day,

I have been struggling since 2015 to get an ammendment done on my daughter's birth certificate. I have applied for the changes twice and paid for them twice. I have aquired all the necessary documentation a second time, after Home Affairs informed me some years later that they had lost all my documents.

The second application in 2019 has still not been successful as I have received NO feedback about a date when it will be ready to be collected or sent to me. I have called and emailed countless times and nobody is giving me any answers except to say that it is still being processed.

Please could you tell me if there is any legal action I can take against Home Affairs to get this cleared up? If so, what are the steps and necessary documentation I need to take?

Kind regards,

Mary

Hi there,

I see that you haven't made a payment for the question, but I'm going to assist you a little. If you want to ask a follow-up question, please make the required payment.

You can proceed with a high court application to force Home Affairs to get the changes done, but it will likely cost you about R50,000. You'll need proof of the original application lodged, and the second application.
