Question posted in the General Law category relating to Eastern Cape
Hi there,
I have been unfairly dismissed.
I had been offered a permanent contract and relocated for a job packing up my entire life to relocate to a different province, making new commitments such as renting a flat and taking out a loan to get furniture for my place with the intention of building up my life for a permanant job that I was offered, I should have been secured in for the next year or two to the least, now im in so much debt and unemployed for 4 months already not knowing when I will get a permanent salary again.Yet the company just let me go based on charges of negligence and poor work performance in my probation/learning period, without adequate training and support in order to ensure they have done everything to skill me for the job I thought I was under the impression i was doing so well, due to me doing the exact tasks as per the person that handed her role over to me, yet I was set up for failure in essence, as she got reappointed and I got dismissed, which still does not make sense to me, however I opened an unfair dismissal case with CCMA and as per my CCMA legal adviser the employer agreed or decided to settle out of court with an amount of 3 or 2months compensation.
I feel this is unfair given the fact that I was offered a permanent post and was dismissed without fair training after merely 4 or 5 months of employment with the company.
How can I argue for atleast 12month compensation, am I entitled?
How do I ensure I get fairly compensated?
