Question posted in the Divorce Law category relating to KwaZulu-Natal

My dad who is late, lived with a common law "wife" for the past 12 years.

Dad never pursued a divorced and mum is still legally married to my late dad.

Mum has been through an abuse relationship during her stay with dad, because of the other woman.

Mum has lost her eye sight due to the physical abuse by dad.

the Common law "Wife" states that Mum has signed a document at the local police station " forfeiting her share of the property"

Mum has no recollection of signing such a document and if it was done there is no ways he would have been able to verify the document as she would have been unable to clearly read the document.

We were told by legal advice that no such document can stand in a court of law forfeiting her share of the property unless she has been divorced.

Please assist.
