Child born during marriage. After divorce, child stays with mother.
Initial agreement, father has access to child x2 a week, 2hrs each. Allowed to spend a night with the father, from the time the child turns 4years old.
Child age 5months, mother moved to different town, about 3.5hrs drive away. Notifies father whenever they are close by so that he can see the child.
Since the move, the father only pays maintenance once in a while, whichever amount he wants. Has not phoned to ask about the wellbeing or to talk to the child. Has never visited the child at his home. In the 2years since the move, the father has seen the child no more than 5 times per year, for a few hours each time. The child was diagnosed with Spina Bifida and mild ASD.
Whenever the mother notifies the child's father, that they will be in his town and can visit with the child, he askes if he may take the child away with him for a few hours. The child does not know the father, as the father has never attempted to form a proper relationship with the child.
My question that I want answered:
Is the father allowed to take the child away from the mother for a few hours, keeping in mind his limited relationship with the child?
