Question posted in the Insurance Law category relating to Western Cape
The late Mr Dwyer (Johan) was insured by Old Mutual. The claim submitted by Mrs Dwyer (Maryna) has been denied on grounds of Johan alledgedy not answering truthfully on some of the questions on the application form.
According to Maaruna, and also broker invilved with the application, all questions were answered truthfully as per the descriptions explaining the nature of the questions.
Some of the medical terms used in the medical practitioner's report isnmot commonly used by lay persons, and does give scope of mis understanding of the questions asked.
Old Mutual also requested blood samples on two occasions from Johan before accepting the insurance risk.
The letter received from Old Mutual is available for scrutiny if required.
Please advise to the cost of: -
1> Will it be feasible to appeal the denial.
2> To representing Maryna with the appeal.
The insured vaue is R650 000.00.
